Until recently, gambling was regulated through the Netherlands gaming control
board (College van toezicht op de kansspelen) which was created in 1996. The
gaming control board was a self-governing advisory body for the Minister of
Security and Justice under the Act of Games of Chance. The boards objective
was to supervise the nation's gaming monopoly including that of the Netherlands
State Lottery, De Lotto, Sportech, and Holland Casino. The advisory board
consisted of seven members appointed by the Crown.
For years gambling within the Netherlands was monopolized under the Holland Casino and dubbed Fair Play and it was 100% illegal to live inside the Netherlands and bet online. In fact, the Dutch gambling laws were that severe, that it was illegal to even hold a live game outside of the government run casinos. Since 2005, the government has been pushing to keep their monopolized market under a tight belt, even with the criticism from the EU. A 2008 study produced by "Motivaction" showed that more than 485,000 people living in the Netherlands played online poker or other wagering games online, and that the same people spent more than €450 million during the 2008 fiscal year.
Great strides were made in 2010 when a Dutch court ruled that poker was in fact a game of skill citing " poker has become a different game, depending on tactics, experience and psychology". This ruling has helped in the fight to legalize and regulate online poker and in October of 2010, a prominent Dutch newspaper "telegraaf.nl" announced that the new administration will eventually auction off licenses to online operators.
